Terms of Service

Article 1 (Purpose) These Terms set out the rights, obligations and responsibilities of the Company and the User in connection with the use of the service operated by the Company (the "Service").

Article 2 (What the Service Is) (1) Face & Chart provides a birth-chart and face reading and a Joseon portrait based on the photographs and birth details supplied by the User. The Company chooses the clothing and setting; the User chooses the artistic style. (2) Birth-chart and compatibility products provide readings from the birth details entered by the User. (3) Every result is generated individually for the User’s own order. (4) The Service is based on generative artificial intelligence. The Company discloses this before use, in accordance with Article 31 of the Framework Act on Artificial Intelligence Development and Trust of the Republic of Korea.

Article 3 (Formation of the Contract) The contract is formed when the User has reviewed and accepted the order contents, the payment terms and the limitation on withdrawal, and has completed payment. The saju and compatibility readings can be read in part without paying. For Face & Chart, after a basic photo check the Company shows the User, before payment and at a small size, the reference face drawn from the User’s photograph; the face measurement and the portrait are created after the User has reviewed that face and the product description and paid. How the preview is produced, and how it differs from the finals, is disclosed on the order screen.

Article 4 (Obligations of the User) (1) The User may upload only photographs of themselves, or photographs for which every person shown has given express consent. All legal responsibility arising from the use of another person’s photograph without consent rests with the User, and the Company may stop a confirmed violating order without notice. (2) Requests to generate images from photographs of children or minors are refused and handled in accordance with applicable law. (3) The results may not be used for any unlawful purpose, including impersonating a real person, spreading false information, defamation, or producing sexually explicit material. (4) Persons under the age of 14 may not use the Service. Under Article 22-2 of the Personal Information Protection Act the Company does not collect the personal data of children under 14, and any account or order confirmed to belong to a person under 14 is destroyed without delay.

Article 5 (Rights in the Results) (1) After payment is completed, the User holds the right to use the delivered results for personal, non-commercial purposes. Commercial use is not permitted without a separate agreement. (2) The right to use a result that has been refunded ends at the moment of the refund; using, publishing or distributing it thereafter constitutes copyright infringement.

Article 6 (Quality and Technical Limits) (1) Because of the nature of generative models, the Company does not warrant that a result will be identical to the original photograph, and the likeness and mood may differ with each generation. For Face & Chart, after a basic photo check we show you, before payment and at a small size, the front-facing reference face drawn from your photograph; after payment we measure that reference face and create the reading and portrait. The pre-payment preview is that one reference face, not a preview of the portrait or of the reading. The preview and the finals differ in the number of photographs used and in resolution, and that difference is disclosed on the order screen in advance. Remedies after payment are governed by the Refund Policy. (2) The fortune and face reading is produced by applying fixed rules to a public almanac calculation and to geometric measurements of facial coordinates and proportions, and is provided for entertainment. It does not establish any fact about the User’s past, present or future, and it is not a basis for any decision, including medical, legal, financial, career or personal ones. The Company does not warrant the accuracy of a reading, and is not responsible for decisions the User makes on the basis of one. (3) Scores, grades and similar figures in a reading are a device for entertainment. They do not assess or rank the User’s ability, character or worth.

Article 7 (Limitation on Withdrawal) (1) The results of the Service are digital content whose delivery begins at the moment of payment; from that point withdrawal on the basis of a simple change of mind is limited under Article 17(2)5 of the Act on Consumer Protection in Electronic Commerce (where the provision of a service or of digital content has begun). (2) The results are also generated individually for the User’s own order from the User’s photograph and choices, so Article 17(2)6 of the Act and Article 21 of its Enforcement Decree apply as well; as those provisions require, the Company discloses this separately before payment and obtains the User’s consent by electronic document. (3) Under Article 17(6) of the Act the Company states clearly on the payment screen that withdrawal is limited, and provides as the trial product a free portion of the saju and compatibility readings that can be read without paying and, for Face & Chart, a small pre-payment preview of the reference face drawn from your photograph. The Face & Chart measurement and portrait are created after payment; non-delivery and verifiable creation defects are handled under the Refund Policy. However, under Article 17(3) of the same Act, the right of withdrawal is not limited where the result differs from what was displayed or advertised, or where the contract has been performed differently from its terms.

Article 8 (Limitation of Liability) (1) The Company is not liable for damage arising from causes beyond its reasonable control, including natural disasters and outages at the external generation model provider. The Company will, however, refund any portion of the amount paid that was not delivered, in accordance with the Refund Policy. (2) Paragraph (1) does not exclude liability arising from the Company’s intent or gross negligence (Article 7(1) of the Act on the Regulation of Terms and Conditions).

Article 9 (Disputes) Disputes relating to the Service are resolved by mutual agreement. Where agreement is not reached, the User may apply for mediation to the 1372 Consumer Counselling Centre (dial 1372 in Korea), the Consumer Dispute Mediation Committee of the Korea Consumer Agency, or the Electronic Document and Electronic Transaction Dispute Mediation Committee operated by the Korea Internet & Security Agency. Actions are brought before the court having jurisdiction under the Civil Procedure Act of the Republic of Korea.

Article 10 (Delivery and Technical Requirements) (1) The birth chart preview, the basic photo check and the small preview of the reference face drawn from your photograph are free. The Face & Chart measurement and portrait are created after verified payment. The reference face of a request that is not paid for is deleted 48 hours after the request was made. (2) Face & Chart creation starts or resumes in the browser after returning from payment. If creation fails, we try once more with the same photo; if it still does not finish, the full amount paid is refunded automatically under section 3(1) of the Refund Policy. The saju and compatibility readings are generated after payment is verified. If generation makes no progress for more than 15 minutes, the Company marks the order failed and refunds the payment automatically. (3) Results are delivered as image files downloaded through a web browser; no separate software installation is required. A current version of a web browser is needed. (4) For Face & Chart, the basic photo check and the measurement of the front-facing reference face run in the User's browser. The reference face is generated before payment and shown at a small size; the measurement runs after payment. The original face is not measured for a pre-purchase face reading. Facial measurements (26 indicators) and birth details are sent to the Company's servers for judgement and chart calculation. A smaller source photo is kept temporarily on the User's device and passes through the Company's servers to the generation provider when the reference face is made; it is not kept as a file in the Company's storage. Generated reference faces, portraits and reading results are kept in Company storage. (5) Photographs and results held by the Company are deleted under the product-specific 14-day retention rules in section 3 of the Privacy Policy. That policy explains when each period starts, and the separate terms for temporary browser photos, unpaid drafts and external provider retention. (6) The results of the Service are digital content transmitted over an information and communications network and are paid for by credit card or similar means; accordingly, under Article 24(3) of the same Act, they are not subject to payment escrow or to a consumer damage compensation insurance contract.

Article 11 (Hosting Provider) Hosting for the Service is provided by Vercel Inc.; image files are stored by Cloudflare, Inc.
